கூகுள் இந்திய சந்தை மீது அதன் ஆதிக்கத்தை தவறாக பயன்படுத்தியதற்காக- CCI அபராதம்

இந்திய போட்டி ஆணையம் (Competition Commission of India-CCI) ஆண்ட்ராய்டு மொபைல் சாதன சுற்றுச்சூழல் அமைப்பில் அதன் ஆதிக்கத்தை தவறாக பயன்படுத்தியதற்காக Google க்கு அபராதம் விதித்துள்ளது.

மொபைல் இணைய உலாவிகள் மற்றும் ஆன்லைன் வீடியோ ஹோஸ்டிங் ஆகியவற்றில் குரோம் மற்றும் யூடியூப் போன்ற அதன் பயன்பாடுகளைப் பாதுகாக்க, ஆன்லைன் தேடல் மற்றும் ஆப் ஸ்டோர் மூலம் கூகுள் தனது ஆதிக்க நிலைகளை தவறாக பயன்படுத்தியதை CCI கண்டறிந்தது.

எனவே, போட்டி கண்காணிப்பு நிறுவனம், தொழில்நுட்ப நிறுவனத்திற்கு ரூ.1,337.76 கோடி அபராதம் விதித்தது.

2018 ஆம் ஆண்டில், ஐரோப்பிய ஒன்றியம் இதே காரணத்திற்காக கூகுளுக்கு 4.34 பில்லியன் யூரோக்கள் (சுமார் ரூ. 35,541 கோடி) அபராதம் விதித்தது. ஆனால், பின்னர் அது 4.125 பில்லியன் யூரோக்களாக (சுமார் ரூ.33,296 கோடி) குறைக்கப்பட்டது.

10 ஆண்டுகளுக்கும் மேலாக நீடித்த 3 விசாரணைகளுக்குப் பிறகு, நம்பிக்கைக்கு எதிரான மீறல்களுக்காக ஐரோப்பிய ஒன்றியம் தொழில்நுட்ப நிறுவனத்திற்கு மொத்தம் 8.25 பில்லியன் யூரோக்கள் (சுமார் ரூ. 66,600 கோடி) அபராதம் விதித்தது.

இந்தியாவில் உள்ள 600 மில்லியன் ஸ்மார்ட்போன்களில் 97 சதவீதம் ஆண்ட்ராய்டு இயங்குதளத்தால் இயக்கப்படுகிறது. இது நாட்டை Google இன் மிகப்பெரிய சந்தையாக மாற்றுகிறது.

தேடல், குரோம், யூடியூப், கூகுள் ப்ளே ஸ்டோர், மேப்ஸ், புகைப்படங்கள் மற்றும் பலவற்றை மொபைல் போன்களில் முன்-நிறுவுவதற்கும், அவற்றை முக்கிய பதவிகளில் வைப்பதற்கும், OEMகளை கட்டாயப்படுத்த கூகுள் தனது ஆதிக்க நிலையைப் பயன்படுத்தியதை CCI கண்டறிந்தது.

சட்டத்தின்படி, ஒரு நிறுவனம் நேரடியாகவோ அல்லது மறைமுகமாகவோ வாங்குவதில் நியாயமற்ற அல்லது பாரபட்சமான நிபந்தனைகளை விதித்தால் சந்தையில் அதன் மேலாதிக்க நிலையை தவறாகப் பயன்படுத்துகிறது அல்லது பொருட்கள் அல்லது சேவைகளின் விற்பனை.

சட்டத்தை மீறியதற்காக அபராதம் விதிப்பதைத் தவிர, போட்டிக்கு எதிரான நடைமுறைகளில் ஈடுபடுவதைத் தடுக்க கூகுள் நிறுவனத்திற்கு எதிராக CCI நிறுத்துதல் மற்றும் விலக்கு உத்தரவுகளை பிறப்பித்தது.

Google இன் தனியுரிம பயன்பாடுகள் மற்றும் சேவைகளை முன்கூட்டியே நிறுவுவதற்கு OEMகள் கட்டாயப்படுத்தப்படக்கூடாது என்று அது கூறியது. பயனர்களால் முன்பே நிறுவப்பட்ட பயன்பாடுகளை நிறுவல் நீக்கம் செய்ய அனுமதிக்குமாறு தொழில்நுட்ப நிறுவனத்திற்கு உத்தரவிட்டது.

கூகிள் தனது தேடல் சேவைகளுக்கான பிரத்தியேகத்தன்மையை உறுதி செய்வதற்காக OEM களுக்கு பணம் அல்லது பிற சலுகைகளை வழங்குவதும் தடைசெய்யப்பட்டுள்ளது.

CCI Penalty on Google

 

The Competition Commission of India (CCI) has imposed a penalty on Google for abusing its dominance in the Android mobile device ecosystem.

Key facts

The CCI found that Google abused its dominant positions via online search and app store to protect its apps like Chrome and YouTube in mobile web browsers and online video hosting.

Hence, the competition watchdog imposed a fine of Rs 1,337.76 crore on the tech giant.

In 2018, the European Union imposed a penalty of 4.34 billion euros (around Rs 35,541 crore) on Google for the same reason. However, it was later cut to 4.125 billion euros (approximately Rs 33,296 crore).

The EU had fined the tech giant a total of 8.25 billion euros (around Rs 66,600 crore) for anti-trust violations after 3 investigations that lasted for over 10 years.

97 per cent of 600 million smartphones in India are powered by the android operating system. This makes the country Google’s largest market by users.

The CCI found that Google used its dominant position to mandate OEMs to pre-install its entire Google Mobile Suite like Search, Chrome, YouTube, Google Play store, Maps, Photos, and others on mobile phones and place them in prominent positions.

This mandate goes against Section 4(2)(a)(i) of the Competition Act, 2002.

According to the Act, an enterprise abuses its dominant position in the market if it directly or indirectly imposes unfair or discriminatory conditions in the purchase or sale of goods or services.

Besides imposing a fine for the violation of the Act, the CCI issued cease and desist orders against Google to stop it from indulging in anti-competitive practices.

It stated that OEMs should not be mandated to choose Google’s proprietary applications and services to be pre-installed. It also ordered the tech giant to allow uninstalling of pre-installed apps by users.

Google is also prohibited from offering any monetary or other incentives to OEMs for ensuring exclusivity for its search services.
